Terms of Service

1. The service

AvatarSay creates original avatar images from text descriptions and short talking videos from a source image, a script and a voice. Some features cost credits. We may add, change or remove features over time, but we will not take away credits you have already purchased.

The service is provided as-is. Generated results vary. We do not guarantee that a particular prompt, face, voice or style will produce a result you like, or that a generation will always be available.

2. Accounts

You need a Google account to sign in. You are responsible for activity under your account and for keeping access to your Google account secure. You must be at least 18 years old, or the age of majority where you live, to purchase credits or create a talking video.

One person, one account. Do not create accounts to evade a suspension, abuse free credits, or interfere with other users. You must provide accurate information and may not impersonate another person.

3. Credits and payments

Credits are a prepaid unit used inside AvatarSay. They are not money, do not earn interest, and cannot be transferred or exchanged outside the service. Credits never expire.

Payments are processed by Waffo, our Merchant of Record. Waffo handles the checkout page, payment methods, taxes and refunds. We do not receive or store your full card details. Prices and credit amounts are shown before checkout and may change for future purchases.

You are responsible for any taxes that apply to your purchase, except where Waffo collects them. If a payment is reversed, we may remove the corresponding credits, including credits already spent, and suspend the account until the balance is resolved.

4. Your prompts, uploads and outputs

You keep ownership of the prompts and images you upload. Subject to the rights described below, you also own the avatar images and videos you generate.

You grant us a limited license to host, copy, resize, transmit and process your uploads, prompts and outputs only as needed to provide the service, keep it secure, and comply with the law. This license ends when you delete the content, except for backup copies that expire on our normal schedule and records we must keep for legal or accounting reasons.

You must have the rights to the images you upload, including the consent of any person shown. Do not upload images of other people without permission. Do not use the service to impersonate anyone.

5. AI-generated content

Avatars and videos are generated by AI and may contain mistakes, artifacts or similarities to existing people or works. They are not photographs of real people unless you uploaded a real photo. Do not present generated people as real, and do not use the service to create deceptive content about a real person.

Where a platform, employer, publisher or law requires you to disclose that content is AI-generated, you are responsible for doing so.

6. Acceptable use

Your use of AvatarSay must follow our Acceptable Use Policy. Prohibited content includes sexual content, minors, real public figures, impersonation, non-consensual images, harassment, hate speech, threats, fraud and illegal activity.

We may review, remove or refuse content, suspend or close accounts, and report serious violations to the relevant authorities. Credits spent on prohibited content are not refundable.

7. Our intellectual property

AvatarSay, its name, logo, interface and underlying software are owned by us or our licensors. These terms do not give you the right to copy, resell, scrape or reverse-engineer the service, or to use our branding without permission.

You may use the avatars and videos you generate for personal and commercial projects, subject to these terms and the Acceptable Use Policy. You may not sell access to the service itself or present it as your own product.

8. Disclaimers and liability

The service is provided “as is” and “as available”. To the extent allowed by law, we disclaim implied warranties of merchantability, fitness for a particular purpose and non-infringement. We do not guarantee uninterrupted availability, perfect likeness, or that generated content will be free of third-party claims.

To the extent allowed by law, our total liability for any claim related to the service is limited to the amount you paid us in the 12 months before the claim. We are not liable for indirect, incidental, special or consequential damages, or for lost profits or data. Nothing in these terms limits rights that cannot be limited by law.

9. Suspension and termination

You may stop using the service at any time. We may suspend or close an account if you violate these terms or the Acceptable Use Policy, if we are required to by law, or if your account creates a security or fraud risk. If we close an account for a violation, unused credits are forfeited to the extent allowed by law.

You can delete your content from the Dashboard. To request account deletion, email support. We may keep records required for tax, accounting, fraud prevention or legal compliance.

10. Changes and contact

We may update these terms as the service changes. If a change is material, we will make the new version available on this page and update the date at the top. Continued use after a change means you accept the updated terms.
